City of Wilson Ordinance to Amend Transfers

ORDINANCE NO. 853

BEING AN ORDINANCE AMENDING TRANSFERS EFFECTIVE JANUARY 1, 2020 FROM THE SEWER FUND TO THE CAPITAL IMPROVEMENT FUND AND SEWER RESERVE FUND AND FROM THE WATER FUND TO THE CAPITAL IMPROVEMENT FUND AND WATER REPAIR FUND OF THE CITY OF WILSON, COUNTY OF ELLSWORTH, STATE OF KANSAS, AND AMENDING SECTION NO. 1 OF ORDINANCE NO. 824 AND ALL 
OTHER ORDINANCES THAT CONFLICT.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WILSON, KANSAS.
Section 1. Sewer Account Transfers.
That portion of the total user charge collected which is designated for operation and maintenance will be known as the “Sewer Fund”.  That portion of the total user charge collected which is designated for loan repayment and major construction or repair will be known as the “Sewer Reserve Fund”.  That portion of the total user charge collected which is designated for capital improvements will be known as the “Capital Improvement Fund”.   User fees will be deposited into the “Sewer Fund”.  Transfers will be based on sewer sales collected and made in the amount not to exceed 42% to the “Sewer Reserve Fund” and 18% to the “Capital Improvement Fund” monthly or quarterly.
Section 2. Water Account Transfers.
That portion of the total user charge collected which is designated for operation and maintenance will be known as the “Water Fund”.  That portion of the total user charge collected which is designated for loan repayment and major construction or repair will be known as the “Water Repair Fund”.  That portion of the total user charge collected which is designated for capital improvements will be known as the “Capital Improvement Fund”.   User fees will be deposited into the “Water Fund”.  Transfers will be based on water sales collected and made in the amount not to exceed 40% to the “Water Repair Fund” and 20% to the “Capital Improvement Fund” monthly or quarterly.
Section 3.  Repeal of Existing Ordinances.  
Ordinance No. 824 and all other ordinances and partial ordinances that conflict herewith are hereby repealed.
Section 4. Remaining Sections of Ordinance No 824.  
That all other articles, sections, and provisions of said Ordinance No. 824 and shall be and remain the same and are hereby in all respects confirmed and ratified.
Section 5. Effective Date.  
This ordinance shall take effect and be enforced from and after its passage, and approval and publication once in the Ellsworth Co. Independent/Reporter, the official city newspaper.
