City of Holyrood Ordinance to Annex Land

ORDINANCE NO.    620

AN ORDINANCE ANNEXING LAND 
TO THE CITY OF HOLYROOD, KANSAS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF HOLYROOD, KANSAS:

WHEREAS, the following described land adjoins the City of Holyrood, Kansas, and is generally located on the east edge of the City of Holyrood.  
WHEREAS, the following described lands are owned or held in trust by the City of Holyrood, and therefore unilateral annexation is allowed pursuant to K.S.A. 12-520, as amended; and
WHEREAS, the governing body of the City of Holyrood, Kansas finds it advisable to annex such land.
NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF HOLYROOD, KANSAS:
SECTION 1.  That the following described land is hereby annexed and made a part of the City of Holyrood, Kansas:
    Tract 1:
    A parcel of land in the NE ¼ of Section 10 
    T17S R10W of the 6th Principal Meridian, in 
    Ellsworth County, Kansas, with bearings 
    referenced to the Kansas State Plane 
    Coordinate system-North Zone, more 
    particularly described as follows: Beginning 
    at the northeast corner of existing Smith 
    Street at the north line of Olds Avenue 
    in the City of Holyrood also being a point 
    on the west line of a parcel described in Deed 
    Book 42 Page 144 on file at the Ellsworth 
    County Register of Deeds; thence S82°45’48’’W 
    on the east line of said park parcel 90.22 feet 
    to a found 1/2’’ bar in concrete at the northeast 
    corner of said parcel; thence N 83°42’32’’ E on a 
    line extended from the north line of said 
    parcel 80.06 feet to a point on an extended line 
    from the west line of a parcel described in 
    Deed Book 43 Page 428; thence S 06°12’31’’E 
    on said extended west line 33.75 feet to a found 
    ¾’’ smooth bar at the northwest corner of said 
    parcel; thence continuing S 06°12’31’’ E on the 
    west line of said parcel and a parcel described 
    in Deed Book 42 Page 144 (the first parcel 
    noted above), a distance of 55.15 feet to the 
    Point of Beginning. 
This parcel has an area of 7,172 square feet or 0.165 acres, more or less, and is subject to all applicable easements, leases, and rights of way.
    Tract 2:
    A Tract of land in the West Half of Section 11, 
    Township 17 South, Range 10 West in 
    Holyrood, Ellsworth County, Kansas being 
    more particularly described as follows:
    Commencing at the West Quarter Corner of 
    Section 11, Township 17 South, Range 10 
    West; Thence along the west line of said Section 
    11 North 00’05’54’’ East, 149.84 feet; thence 
    leaving said west line North 89’41’32 East, 
    30.00 Feet to the East Right-of-Way line of 5th 
    Road; thence leaving said East Right-of-Way 
    line and continuing North 89°41’32’’ East, 
    612.32 Feet; Thence North 00°03’56’’ East, 
    216.41 Feet to the South Right-of-Way line 
    of the Atchison, Topeka and Santa Fe Railroad 
    and the point of beginning; thence along 
    said South Right-of-Way line whose cord 
    bears North 89°09’11’’ East, 345.64 Feet; 
    Thence leaving said South right-of-way line 
    South 00°01’43’’ West, 952.55 Feet; Thence 
    North 89°20’26’’ West, 559.58 Feet; Thence 
    North 00°03’56’’ East, 917.90 Feet to the south 
    right of way line of the Atchison, Topeka and 
    Santa Fe railroad and point of beginning. 
    All lying in the West Half of Section 11, Township 
    17 South, Range 10 West in Holyrood, Ellsworth 
    County, Kansas, containing 12.13 Acres, more 
    or less. Bearings are assumed on the west line 
    of the Northwest Quarter of Section 11, 
    Township 17 South, Range 10 West. Subject 
    to all easements, covenants, restrictions and 
    reservations of record.
Along with a 40’ strip of land for an ingress/egress easement lying along and parallel to the North line of the Tract Shown hereon.
SECTION 2.  This ordinance shall take effect and be in force from and after its publication in the official city newspaper.
PASSED by the governing body of the City of Holyrood, Kansas, this 17th day of February, 2020.
